General Terms and Conditions of Transport and Sales

CROSSINGS TO THE ISLANDS OF MORBIHAN: BELLE-ÎLE-EN-MER, GROIX, HOUAT, HOËDIC

The object of these General Conditions complemented by the Special Conditions of Carriage of Goods (the “General Conditions”) is to govern the conditions of purchase, subscription and use of tickets for use on the maritime connections operated by Compagnie Océane (the “Ticket(s)”).

By public service concession, the Brittany Regional Authority (Conseil Régional de Bretagne) has entrusted Compagnie Océan (the “Operator”) with the management and operation of the maritime public transport service for passengers, vehicles and goods between the mainland and islands of Southern Brittany (Belle-Île-en-Mer, Île de Groix, Île de Houat and Île de Hoëdic). Compagnie Océane is a société par actions simplifiée with a capital of EUR 290 000, registered with the Lorient business register (RCS Lorient) under number 492 497 490, with registered address: Gare Maritime, Rue Gahinet, CS 55582, 56325 Lorient Cedex (the “Carrier” or “Compagnie Océane”).

The General Conditions shall apply to all passengers or shippers (“Passenger(s)”), whether buyers or holders of a Ticket, in whatever form. They shall be subject, for maritime passenger transport, to Regulation (EC) No 392/2009 of 23 April 2009 and Regulation (EU) No 1177/2010 of 24 November 2010 concerning the rights of passengers when travelling by sea and inland waterway, and, for maritime goods transport, to the French Transport Code (Code des Transports). These General Conditions, taken in conjunction with the aforementioned European regulations and, where applicable, the aforementioned Transport Code, shall together form the contract of carriage governing the obligations between the Passenger and Compagnie Océane, applicable to all maritime connections operated by the latter and represented by the Ticket.

By agreeing to travel on Compagnie Océane’s vessels and purchasing Tickets to make a journey or send a shipment, the Passenger agrees without reservation to these General Conditions, in his/her own name and on behalf of his/her heirs or beneficiaries. That agreement also concerns any person travelling with the Passenger, namely children or any person travelling under the Passenger’s protection, charge or supervision, and their insurers.

Boarding implies the strict application of all the conditions of carriage of Compagnie Océane, including the current fare conditions, the latter (see annex, “Fare Conditions”) also being applicable to these General Conditions.

The provisions of these General Conditions shall be applicable in the event that a replacement vessel is chartered by Compagnie Océane from another shipowner.

The General Conditions are available upon request at the ferry terminal, as a hard copy or in electronic format, and may be consulted, saved and printed at any time from the Compagnie Océane website, accessible to all: www.compagnie-oceane.fr/fr/Conditions-générales-transport-et-ventes.

Compagnie Océane reserves the right to update the General Conditions (in particular as regards fare amendments). The new General Conditions shall be notified to Passengers by means of posters in the ferry terminals and on the website. Accordingly, Passengers are advised to read the General Conditions carefully whenever they visit Compagnie Océane’s website.

The date on which the General Conditions were last updated shall be stated on the document.

Under no circumstances may the Carrier be held liable for any changes to routes and/or timetables, rerouting, service interruptions, cancellations or delays in the performance of the contract of carriage, resulting from an event not attributable to Compagnie Océane or due to force majeure (namely unfavourable weather conditions, shipwreck, collision, approach of mooring or port of call, quarantine, fire, act of war or piracy, or strike), or arising from Compagnie Océane’s obligation to provide assistance to other vessels in difficulty pursuant to Article 20. Any damage arising from these events, such as costs and risks related to stays, shall be Passengers’ responsibility.

Where the Carrier may reasonably expect a change in departure time or a delay during the crossing, it shall notify Passengers. In the event that the Carrier is held liable, no compensation shall be payable for a delay of less than one hour.

The crossing times displayed on marketing materials and on Tickets do not take account of delays to boarding and disembarkation that increase journey time.

3.1 – General provisions

Passengers must be in possession of a valid Ticket in order to board. Holders of multi-trip Tickets must be in possession of the corresponding non-transferable season ticket. Passengers unable to present a valid season ticket will be required to pay a single fare if they wish to board the vessel.

Those entitled to concessionary travel must spontaneously present their concessionary travel card or season ticket together with the required supporting document (identity card), both when purchasing Tickets and when boarding; photocopies are not accepted. Where there is a delay in processing the Passenger’s ticket due to a failure to present a valid concessionary travel card (for instance the carte d’insulaire – islander card) or season ticket together with supporting document, thereby preventing the Passenger from boarding within the time limit, under no circumstances may Compagnie Océane be held liable.

Transport is free for children under four years old. However, they must be in possession of a Ticket to allow Passengers to be counted when boarding.

It is prohibited for any Passenger :

  • to use a Ticket under unlawful conditions (namely in violation of the general fare conditions);
  • to use a Ticket that has been altered or prepared in such a way as to facilitate fraud;
  • to transfer, resell or lend, whether or not in exchange for payment, a Ticket, season ticket or concessionary travel card;
  • to use a Ticket, season ticket or concessionary travel card not belonging to them.

Season tickets and islander cards are personalised with the full name and photograph of their holder. They are therefore strictly personal and non-transferable, and are the property of Compagnie Océane or, in the case of the islander card, the Regional Authority. Consequently, any fraudulent use of a season ticket, islander card or concessionary travel card by its holder, as the perpetrator or accomplice to fraud (falsification, counterfeiting, loan to a third party, etc.), detected during a Ticket check, may lead to them being prevented from boarding the vessel, having their season ticket or travel card immediately confiscated by a member of Compagnie Océane staff and possible prosecution.

The Carrier may also legally cancel the season ticket, by notifying the Passenger, in the event of proven, repeated fraud or outstanding debts.

The fares are stated in the Fare Conditions, which may be consulted from Compagnie Océane. None of the Ticket services are subject to application of the right of withdrawal applicable to distance selling (Article L.221-2 of the French Consumer Code – Code de la Consommation).

3.2 – Ticket checks

Passengers must hold Tickets corresponding to the category and nature of the service they are using. They are responsible for properly preserving their Ticket and must, for the duration of their journey, i.e. until they disembark from the vessel, be able to produce it when requested by any authorised member of Compagnie Océane staff.

Compagnie Océane staff may carry out ticket checks at any time during the crossing, as well as at boarding and disembarkation in the areas designated for that purpose. On request, Passengers must produce their Ticket and valid supporting document.

Tickets must be paid for on booking. Payment for the Ticket is required for a place to be reserved on board the vessel.

Tickets may be booked and paid for online on the Compagnie Océane website www.compagnie-oceane.fr, by telephone on 0820 056 156, at automatic ticket machines or at ticket desks.

On the Compagnie Océane website or by telephone, Tickets are paid for online by credit card using a secure payment system. Payment by cheque or holiday voucher is possible by telephone. However, places will only be booked on receipt of the latter, subject to availability.

At the ticket desks, payment is accepted in cash, by credit card, cheque or holiday voucher. All Tickets purchased at the ticket desk may incur an issuing fee of € 1 per booking.

Tickets may be sold for immediate departure on the day of the journey, according to the remaining places available.

Passengers are required to check the Tickets issued and the change given before leaving the ticket desk. No claims in respect of the Tickets issued or change given can be accepted subsequently without adequate proof.

The Passenger must provide the exact money, so that Compagnie Océane is not required to give any change (Law of 22 April 1871, Article L.112-5 of the French Monetary and Financial Code – Code Monétaire et Financier). Passengers entitled to concessionary travel must assert that entitlement before purchasing their Tickets, and always produce their concessionary travel card when purchasing Tickets, boarding and during Ticket checks. No amendments or reimbursements are possible once the journey has been made.

No Passenger Ticket duplicates shall be issued, regardless of the reason for the request. In the event of loss, theft or any other similar event, the Passenger must purchase a new Ticket.

Invoices issued by Compagnie Océane are payable upon receipt. The failure to do so shall automatically incur late-payment interest at three times the legal interest rate, with no reminder being required; that interest shall be payable without the need for prior notice to be served. These penalties shall be calculated based on the full amounts payable, including VAT, from the date the payment falls due until it has been settled in full. The Passenger must also pay any recovery costs, without prejudice to the payment, in accordance with ordinary law, of any other damages arising as a direct result of this delay.

8.1 – Ticket amendment terms

Tickets may only be amended subject to availability. Ticket amendments made at the ticket desk must be made during the latter’s opening hours, which can be viewed on the Compagnie Océane website: https://www.compagnie-oceane.fr/fr/accueil.

These Ticket amendment terms do not apply to Tickets purchased using works council vouchers, such Tickets being subject to the terms and conditions of said vouchers.

Individual adult non-islander Passengers :

  • Up until departure, there is a € 1 amendment fee per Ticket.
  • For an earlier departure on the same day, a booking can be amended free of charge.
  • From departure until 12 hours after departure, the amendment fee is € 4 per Ticket.
  • Between 12 and 48 hours after departure, the amendment fee is € 8 per Ticket.
  • No amendments are permitted more than 48 hours after departure. In such cases, the full Ticket price is retained by Compagnie Océane.

Season ticket holders and individual child Passengers :

  • Up until departure, there is a € 1 amendment fee per Ticket.
  • For an earlier departure on the same day, a booking can be amended free of charge.
  • From departure until 12 hours after departure, the amendment fee is € 1.50 per Ticket.
  • Between 12 and 48 hours after departure, the amendment fee is € 2 per Ticket.
  • No amendments are permitted more than 48 hours after departure. In such cases, the full Ticket price is retained by Compagnie Océane.

Individual islander Passengers :

  • A reserved Ticket can be amended free of charge up to the time of departure, subject to availability.
  • If the Passenger does not show up for boarding, the Ticket cannot be refunded However, after departure, the Ticket can be amended once, free of charge, at our ticket desks only, for travel within three months.

 

 

To be taken into account, amendments must be made during opening hours, at the ferry terminal ticket desks or via the telephone booking line or website of Compagnie Océane.

8.2 – Passenger Ticket cancellation terms

Each cancelled journey is subject to a cancellation fee, according to the following conditions :

Individual adult non-islander Passengers :

  • Up until departure, there is a € 4 cancellation fee per Ticket.
  • From departure until 12 hours after departure, the cancellation fee is € 8 per Ticket.
  • More than 12 hours after the departure time, the Ticket will not be refunded.

Season ticket holders and individual child Passengers :

  • Up until departure, there is a € 1.50 cancellation fee per Ticket.
  • From departure until 12 hours after departure, the cancellation fee is € 2 per Ticket.
  • More than 12 hours after the departure time, the Ticket will not be refunded.

Individual islander Passengers :

  • A reserved Ticket can be cancelled free of charge up to the time of departure.
  • After that, the Ticket will not be refunded. However, after departure, the Ticket can be amended once, free of charge, at our ticket desks only, for travel within three months.

In order to be taken into account, cancellations must be made during opening hours, at the ferry terminal ticket desks or via the telephone booking line. No Passenger season ticket or remaining journeys can be refunded.

Please note that cancellation fees are treated as penalties for the non-fulfilment of an obligation, and therefore fall outside the scope of VAT.

9.1 – Vehicle Ticket amendment terms

Tickets may only be amended subject to availability. Each amended journey is subject to an amendment fee, according to the following conditions :

9.1.1 – Two-wheelers less than or equal to 125 cm3

Island and non-island vehicles:

  • Any amendment to a booking is subject to a € 0.50 fee per Ticket up to 48 hours after departure.
  • After this period, the full Ticket price is retained by Compagnie Océane.

 

9.1.2 – Passenger and commercial vehicles or trailers whose height does not exceed 2 m 10 and motorised two-wheelers over 125 cm3

 

Non-island vehicles – all periods :

  • Up to five days before departure, there is a € 7 amendment fee per Ticket.
  • Less than five days before departure, there is a fee of € 16 per Ticket.
  • For an earlier departure on the same day, a booking can be amended free of charge.
  • From departure until 24 hours after departure, the amendment fee is € 32 per Ticket.
  • No amendments are permitted more than 24 hours after departure. In such cases, the full Ticket price is retained by Compagnie Océane.

 

Season ticket holders – all periods :

  • Up until the 5th day before departure, there is a € 4 amendment fee per Ticket.
  • From the 4th day before departure until the date of departure, there is a fee of € 10 per Ticket.
  • For an earlier departure on the same day, a booking can be amended free of charge.
  • From departure until 24 hours after departure, the amendment fee is € 20 per Ticket.
  • No amendments are permitted more than 24 hours after departure. In such cases, the full Ticket price is retained by Compagnie Océane.

 

Island vehicles :

  • Up to one hour after departure, the amendment fee is € 1 per Ticket.
  • Between one and 24 hours after departure, the amendment fee is € 2 per Ticket.
  • No amendments are permitted more than 24 hours after departure. In such cases, the full Ticket price is retained by Compagnie Océane.
  • For an earlier departure on the same day, a booking can be amended free of charge, subject to availability.

 

In order to be taken into account, amendments must be made during opening hours, at the ferry terminal ticket desks or via the telephone booking line or website of Compagnie Océane.

9.1.3 – Passenger and commercial vehicles or trailers whose height exceeds 2 m 10, motorhomes and caravans

Island and non-island vehicles :

  • Up until the 5th day before departure, the amendment fee is 15% of the Ticket price.
  • From the 4th day before departure until the date of departure, the amendment fee is 25 % of the Ticket price.
  • For an earlier departure on the same day, a booking can be amended free of charge.
  • No amendments are permitted after departure. In such cases, the full Ticket price is retained by Compagnie Océane.

 

9.2 – Vehicle Ticket cancellation terms

Each cancelled journey is subject to a cancellation fee, according to the following conditions :

 

9.2.1 – Two-wheelers less than or equal to 125 cm3

Island and non-island vehicles :

  • Any cancellation of a booking is subject to a € 0.50 fee per Ticket up to 48 hours after departure.
  • After this period, the full Ticket price is retained by Compagnie Océane.

 

9.2.2. – Passenger and commercial vehicles or trailers whose height does not exceed 2 m 10 and motorised two-wheelers over 125 cm3

Non-island vehicles – all periods :

  • Up until the 5th day before departure, there is an € 11 cancellation fee per Ticket.
  • From the 4th day before departure until the date of departure, the cancellation fee is € 24 per Ticket.
  • From departure until 12 hours after departure, the cancellation fee is € 48 per Ticket.
  • After this period, no refunds or exchanges are permitted.

Island vehicles :

  • Up to 24 hours after departure, there is a € 4 cancellation fee per Ticket.
  • After this period, no refunds or exchanges are permitted.

 

 

9.2.3 – Passenger and commercial vehicles or trailers whose height exceeds 2 m 10, motorhomes and caravans

Island and non-island vehicles :

  • Up until the 5th day before departure, the cancellation fee is 25 % of the Ticket price.
  • From the 4th day before departure until the date of departure, the cancellation fee is 35 % of the Ticket price.
  • After this period, no refunds or exchanges are permitted.

In order to be taken into account, cancellations must be made during opening hours, at the ferry terminal ticket desks or via the telephone booking line. No vehicle season tickets or remaining journeys can be refunded.

Please note that cancellation fees are treated as penalties for the non-fulfilment of an obligation, and therefore fall outside the scope of VAT.

Passengers are subject to the authority of the master of the vessel. As such, they must abide by all rules and instructions drawn up or issued by Compagnie Océane concerning boarding and disembarking.

Passengers must not disturb their fellow Passengers or Compagnie Océane staff with singing or aggressive comments or use audio devices on board the vessels or on the boarding slipways.

In addition, the Carrier reserves the right at any time to refuse to carry a Passenger, on the following grounds:

  • Where the Passenger presents out-of-date or illegal identity documents.
  • If the Passenger has, or could develop, a serious infectious disease or a disease which is the subject of an official health alert, such as serious respiratory diseases, viruses, tuberculosis or pneumonia.
  • If the master observes that the Passenger has taken narcotic or hallucinogenic drugs or is in a state of inebriation such that they are a danger to themselves and/or other Passengers. In any event, the consumption of alcohol and drugs is not permitted on board.
  • If the attitude or behaviour of a Passenger is not compatible with Passenger or vessel safety, or is likely to cause a breach of the peace.

Compagnie Océane reminds all Passengers that there is no doctor on board during the crossing.

The transport of weapons is subject to the relevant rules, which are available in the ferry terminal and detailed in the annexed document: 12.29-A – annexe transport des armes.pdf (in French)

Smoking is not permitted on board the ferries or in the terminals, except in the designated smoking areas. It is also not permitted to jump into the water.

 

10.1 – People with reduced mobility

Passengers whose mobility is reduced when using a means of transport, due to a physical (sensory or motor, permanent or temporary), learning or other disability, or due to age, and who therefore require special assistance to cater for their specific needs, from a service which is designed to cater for all Passengers (hereafter “Person/People with reduced mobility”), are required to notify the Carrier at the time of booking or purchasing their Ticket of any special requirements concerning their cabin, seat, services required or the need to carry medical equipment or travel with an assistance dog. They may also inform the Carrier if they require assistance to travel on board Compagnie Océane’s vessels.

To be eligible for that assistance, the Person with reduced mobility must:

  • submit to the Carrier, at least 48 hours prior to departure, a request for assistance, setting out their specific requirements. The assistance is free of charge. However, it is the Passenger’s responsibility to contact their insurer to obtain a refund for their travel costs (including those of their companion, where applicable);
  • present themselves at the port of embarkation or designated location for receiving People with reduced mobility, either at a time specified by the Carrier or, where no time has been specified, at least 60 minutes before the scheduled departure time.

Where justified by the specific needs of the Person with reduced mobility notified to the Carrier, the latter may also request the Person with reduced mobility to be accompanied by another person able to provide the assistance required during the crossing.

Notwithstanding the preceding stipulations, the Carrier has the right to refuse a booking, to issue a Ticket or deny boarding to a Person with reduced mobility where:

  • compliance with safety standards justifies it;
  • the infrastructure or equipment of the port or vessel are unable to cater for the embarkation, disembarkation or carriage of the Person with reduced mobility (it is underlined, however, that Compagnie Océane’s vessels are designed in line with the requirements of Division 190 of French maritime law).

In these cases, the Carrier shall refund the Person with reduced mobility for the price of the purchased Ticket.

Any embarking Passenger or driver of an embarking vehicle relinquishes any priority to board if they present themselves for boarding outside the stipulated time limits (45 minutes before departure for vehicles and 20 minutes for Passengers*); furthermore, under such circumstances, they are no longer guaranteed a place on board. Therefore, they renounce any claim against the Carrier on this ground.  The drivers of vehicles are responsible for the embarkation and disembarkation of their vehicle. Any interruption to boarding or disembarkation by a vehicle whose driver is absent, resulting in a delay to the vessel, incurs the liability of the driver or owner of the vehicle concerned for any consequences of such a delay.

* These limits are reduced to 20 minutes for island vehicles and 10 minutes for island Passengers.

When boarding, as set out in Article 3, Passengers must present their Ticket, together, in the case of concessionary travel, with the supporting documents referred to in Article 3.1. Otherwise, the Passenger may be denied boarding, unless they purchase a new valid Ticket.

Children under the age of 14 travel under the supervision and responsibility of a parent or guardian. However, at the request of their parents or legal guardians, minors aged 10 to 13 years may travel alone, on condition that the “Travel authorisation for an unaccompanied minor” form, available at the Carrier’s ticket desks, is signed by their parents or legal guardians when making the booking or purchasing the travel Ticket or season ticket. Therefore, Compagnie Océane cannot be held liable for any loss, damage of any kind or costs arising as a result of a child under 14 years who is travelling alone being denied boarding. Compagnie Océane does not, under any circumstances, transport unaccompanied children under 10 years old.

In addition, Compagnie Océane may refuse to sell Tickets to Passengers under the age of 18 via the website or at the ticket desks, if said Passengers do not have written authorisation from their parents or guardian.  

Animals travel under the full responsibility of their owner, who must take all steps to prevent any incident.

Dogs must be kept on a lead. Under no circumstances may they occupy the seats. Category 1 or 2 dogs must be muzzled and kept on a lead.

Very small dogs travel free of charge if they are carried in a basket or their owner’s arms. Compagnie Océane, through its staff, in particular the master of the vessel, may deny access on board a vessel to an animal that could represent a risk to Passengers. No refund or exchange of Ticket will be possible.

Under no circumstances does the admission of any animal on board relieve the Passenger in charge of the animal of any liability in the event of an attack by the animal or damage of any nature caused by the animal.

Any damage caused to the vessel, its facilities, other Passengers or third parties by a Passenger or by objects, people or animals in their charge is the Passenger’s sole and entire responsibility. The Passenger must make good all damage thus caused, as well as any other damage or interest claimed by the Carrier or any third parties concerned.

15.1 – Damage to people

The Carrier cannot be held liable for any bodily harm suffered by Passengers as a direct result of the Passenger’s own fault, carelessness or neglect or a force majeure event. During the crossing, Passengers must behave appropriately, sensibly and in accordance with safety rules.

15.2 – Damage to property

The Carrier cannot be held liable for the theft, disappearance or any other damage to Passengers’ valuables (including vehicles, smartphones, tablets, computers, etc.) or baggage, unless it is demonstrated that damage is the direct result of the Carrier’s neglect, carelessness or fault.

Nor can the Carrier be held liable for any damage to the vehicles being transported, during boarding and disembarkation, unless it is shown that that damage is directly attributable to the instructions given to drivers by Compagnie Océane staff.

The terms and conditions for the carriage of goods are set out in the Special Conditions of Carriage of Goods.

In addition to the Special Conditions, it is specified that, in the event of damage caused to goods carried by the Carrier, from their receipt by the latter to the arrival of the vessel, the Carrier can be held liable unless that damage is the result of the vessel’s unseaworthiness, fire, events not attributable to the Carrier, strike, lock-out, stoppage or restraint of labour for whatever cause, whether partial or general, an inherent defect of the goods or wastage during carriage, the fault of the shipper, hidden defects of the vessel, an act or attempt to save life or property at sea, or nautical fault of the master, pilot or other servants of the Carrier.

The Carrier can only be held liable in respect of any damage to goods during carriage up to the limit of liability set out in the Special Conditions of Carriage of Goods. 

Packages are the responsibility of the shipper until their receipt by Compagnie Océane staff and of the consignee after their receipt by the consignee. Compagnie Océane can only be held liable for damage to packages during the crossing resulting from the proven fault, carelessness or neglect of Compagnie Océane or its servants. Compagnie Océane cannot be held liable if the damage is due to the absence or inadequacy of packaging.

If a package consigned to Compagnie Océane is not claimed at the port of arrival, Compagnie Océane may keep said package in an appropriate storage facility until it is claimed. Compagnie Océane may bill for any appropriate storage costs. Compagnie Océane may dispose of any perishable items contained in the package. Compagnie Océane cannot be held liable for loss or damage to the stored package.

Each Passenger may carry up to 30 kg of personal baggage free of charge, with no equalisation between passengers. Excess baggage is charged at the unaccompanied package/baggage rate. “Baggage” means any item carried, except for live animals or bulky goods. Baggage must be labelled and identified with its owner’s name and address. Compagnie Océane cannot be held liable for any loss, damage of any kind or costs arising as a result of a Passenger’s failure to comply with this rule. Compagnie Océane has the right to refuse any baggage which is not properly packed, labelled or is visibly damaged. Passengers are responsible for stowing on board and taking away any baggage they are carrying. They must also ensure that their baggage does not obstruct the emergency exits or access for the emergency services.

Baggage and personal belongings shall remain in Passengers’ charge and supervision during the crossing. Compagnie Océane therefore accepts no liability in the event of theft, disappearance, loss or damage to baggage or personal belongings, except in the cases referred to in Article 15.2. Similarly, Compagnie Océane cannot be held liable for any loss, damage of any kind or costs in respect of baggage or other personal belongings (other than those consigned to Compagnie Océane and not claimed) left on its premises or vessels.

The transport of dangerous goods on passenger vessels is strictly regulated and is subject to a prior declaration to Compagnie Océane. This includes in particular the transport of hydrocarbons, gases or any inflammable or explosive substance listed in the International Maritime Dangerous Goods (IMDG) Code published by the International Maritime Organization (IMO), specified in national legislation or rules specific to Compagnie Océane. Accordingly, baggage must not contain any inflammable, explosive or corrosive substances, firearms, loaded or otherwise, or any other items which could represent risks to Passengers, Compagnie Océane staff and third parties.

Any Passenger who embarks dangerous and prohibited goods without Compagnie Océane’s knowledge is liable to prosecution, without prejudice to any other damages and interest or penalties laid down by French law. The Special Conditions of Carriage of Goods specify the conditions restricting the transport of dangerous goods.

Accordingly, neither the baggage nor the vehicles being transported may contain any inflammable substances (except in vehicle fuel tanks), explosive or corrosive substances, firearms, loaded or otherwise, or any other goods which could represent risks to Passengers, Compagnie Océane staff and third parties.

In the event of an object being lost or left on board, the Passenger must notify the ferry terminal in person.

The master is permitted to tow, provide assistance to vessels in all circumstances, reroute and carry out rescue or transfer operations, such that Passengers renounce any claim on this ground.

Having contacted Compagnie Océane’s customer services and not received a satisfactory response within 60 days, the Passenger may apply, within one year of the date of registration of their claim with customer services, to the Travel and Tourism Ombudsman (Médiateur du Tourisme et du Voyage), whose contact details and claims procedure are available on the website www.mtv.travel.

All disputes concerning the enforcement of these General Conditions of Carriage fall within the jurisdiction of the Cour d’Appel de Rennes. The only applicable law is French law.
